Abstract

The following research seeks to evaluate the way in which some international bodies have analyzed the customary status of Common Article 3 to the four Geneva Conventions of 1949 and Additional Protocol II of 1977, applicable to non-international armed conflicts. It will aim to question said assessments for the serious methodological problems they present, and to conclude that the customary character of these norms, albeit limited, can only be founded on their extensive acceptance as treaties.
