Abstract

This paper proposes the design of a type of equality analysis that goes beyond the inadequacies of the traditional formal and material formulas as non discriminatory principle. To that effect, the authors deal with the concept of equality as non domination and integrate it with the approach of Nancy Fraser’s theory of redistribution
and recognition. Afterwards, the article accounts for this type of exam applied to the
re-interpretation of the new paradigmatic cases subjected to the control of the InterAmerican Court of Human Rights. These cases deal with the problematics of indige-
nous people related to the communities’ dignified living conditions, as well as their
collective propriety rights and political participation in a representative democracy.
