The confusing collapse of the Fourth Republic led to the reappearance of Charles de Gaulle in the French political scene. The Constitution of the Fifth Republic was therefore originated and immersed in a deep political and institutional crisis resulting from the Algerian War. As a consequence of the opposing influence of two leading characters closely related to General De Gaulle, i.e. Michel Debré and René Capitant, the then new Constitution implied political tensions which had to be solved by political actors, especially by the President of the French Republic. Thus, it is the object of study of the present work to analyse and to study how said political tension was pragmatically overcome.
