“Montalvo”, el buen padre de familia y el terrible Odradek

Abstract

In this case analysis, the author criticizes the role of the State, through its
different bodies, as regards the punishment of personal consumption of narcotics in the light of case “Montalvo”. To illustrate his point, he makes a comparison between Kafkian character Odradek and the position to be adopted by the individual —who becomes the target of the punitive power— before the paternalist authority exercised by the State.
