The phenomenon of integration as the origin of new legal statutes: Mercosurian law, hierarchy and compliance

Abstract

The article has the objetive to address the reader to the opportunity of assessing the importance about being part of an integration process and the influence within of the jurdical element. In addition, the law created through that process generates a cascade effect along the juridical orders of the States Parties, which is necessary to contemplate, but once in practice it has no obstacles, except the politic system. The aforementioned means that, the new legal order should be framed in those States to imposing, balancing or submitting it to respect their national legal orders. In this contribution, it can be seen the up and down streams of the MERCOSUR ́s law and its developing. Furthermore, this is going to help the public to understand the MERCOSUR ́s system, its perspectives and challanges that it faces when enhancing teory and practice. The latter conduces to questioning about the hierarchy, interpetation and aplication of the law it has been created.
