Abstract

The main objective of this study is to determine the range of social rights that children could enjoy and the conditions of their exercise. The question that will guide the analysis will be which are the social rights of children and what would be the obligations of the State to achieve their effectiveness? The work follows the methodology of dogmatic analysis with the technique of documentary examination. Social rights imply a current obligation, not future, of their gradual satisfaction.
This reality is reinforced when we talk about the social rights of children, in respect of which the State has, according to the Convention on the Rights of the Child, the obligation to provide special protection to children throughout all stages of its development and the obligation to consider, as a guiding and primary principle, the principle of the best interests of the child.
