Abstract

From the recognition of children as autonomous subjects, the spanish law approaches the right of children and adolescents to be heard and express their opinion freely in all matters that affect them and, when they are victims of violence, it is required that procedural guarantees are respected at all times and places. All decisions taken must obey the main purpose of protecting the child, safeguarding his subsequent development and ensuring their best interests; besides, care must be taken to ensure that the intervention is the least harmful, depending on what the circumstances require.
