Abstract

The Best Interest of the Child (BIC) does not provide us with general solutions, but rather provides an instrument for weighting the relevant circumstances, which can lead to a solution or another completely different, depending on the context in each case and, of the specific child in relation to whom the measure is to be adopted.
Despite the relevance of the BIC in how many decisions can directly or indirectly affect a child or a group of them, we have to be aware of, like the rest of the legal institutions, the weighting element is implicit in those, to try to balance interests in presence and avoid unwanted solutions.
