THE WRITING IN THE ARGENTINE BODIES. THE CASE OF ARTICLE 19 IN THE NEW CIVIL AND COMMERCIAL CODE

Abstract

The main objective in this article is to analyze and show the transformations of the debate around the beginning of the existence of human being in the context of a punctual process, which led to the current drafting of the 19th article of the Civic and Commercial Code. To do so we have defined the parliamentary debates as our analysis unit focusing in the arguments expressed by the legislators in the "Diputados" and "Senadores" chambers in 2014, in which the Civic and Commercial code was approved.

Our main hypothesis is that in this debates around the uses of some terms, the possibility of determinate the limits of women´s bodies (and also from other gender groups) is at stake in Argentina. This bodies are configured as territories and their borders are objects of struggle. This led to this proposal to carry out of a documental analysis adapting the qualitative strategies of the Grounded Theory and analyzing its results from a critical sociological and philosophical perspective of the legal discourse.
