The 30th anniversary of MERCOSUR and the dimension of legal pluralism in integration spaces

Abstract

In this year 2021, when many were the commemorative events of the 30 years since the MERCOSUR integration process began, it is important to make an evaluation of what has been done from the different points of view, to try to arrive at a situational diagnosis of the present of MERCOSUR. In this regard, it is relevant to review the incidence of integration in the legal world and also observe how the legal structures that sustain these processes have contributed to shaping them from the creation of an ad-hoc Law that assists them. In the following pages we seek to recognize and analyze the existence of a legal pluralism within these integration processes. A legal pluralism capable of recognizing and legitimizing an inter-legality between supra-state and infrastate norms, giving rise to a kind of legal plurality that regulates both the actions of the States and the lives of the citizens of that integrated community. Finally, we will analyze in particular the way and the way in which this pluralism has occurred within the MERCOSUR.
