Abstract

Forty years after the recovery of democracy in Argentina, there is consensus on the incorporation of Argentina into the concert of democratic countries. However, there are still concerns about the democratic character of many subnational units, where practices associated with authoritarianism still persist. This lesson will support two central theses. First, that the legal framework and specialized literature, inspired by the Argentine transition, overlooked the additional difficulties presented by the federal character shared by Argentina and so many other countries. Second, that, in order to solve the persistent democratic and legal problems in these subnational units, it is necessary to abandon the classical notions of transitional justice and expand its scope, something that is already underway within the new theories on the subject. Its application to countries that are already democratized at the national level, but where problems persist at the local level, raises challenges, problems and dilemmas that will be addressed in sections II, III and IV. The paper also includes a section outlining some possible solutions to these dilemmas, proposing ways to activate social changes that lead to the democratization of these jurisdictions. The paper concludes with the idea that, in the most serious cases, the only way to achieve profound changes is through federal intervention accompanied by tools typical of transitional justice.
